Welcome to EmmaMarieArts. By visiting this website and/or placing an order, you agree to be bound by the following Terms of Service (“Terms”). These Terms apply to all users of the website, including browsers, customers, and purchasers of commissioned artwork. If you do not agree with these Terms, you should not use this website or purchase services from EmmaMarieArts.
EmmaMarieArts reserves the right to update, modify, or replace any part of these Terms at any time without prior notice. Continued use of the website following any changes constitutes acceptance of those changes.
Commission Services
EmmaMarieArts provides custom portrait commissions and artwork services, including hand-finished artwork created from customer reference photographs and instructions. Every portrait is created individually and may include artistic interpretation. While every effort is made to accurately capture likeness, colours, and requested details, final artwork may vary slightly from reference images due to the handmade nature of the service and artistic style.
EmmaMarieArts reserves the right to refuse any commission request if the reference material provided is unsuitable, if the request contains offensive or inappropriate content, or if the commission falls outside the artist’s capabilities or style.
Orders & Turnaround Times
To begin a commission, customers must provide clear reference photographs along with accurate order details and any relevant preferences. Work will only begin once payment, or an agreed deposit, has been received.
Estimated turnaround times are generally between 14 and 35 working days unless otherwise stated. During busy periods, waiting lists, holidays, or unforeseen circumstances, completion times may vary. Customers will be informed of any significant delays where possible.
EmmaMarieArts is not responsible for delays caused by incomplete customer information or delayed customer responses during the commission process.
Revisions & Artwork Approval
Reasonable minor adjustments may be offered during the sketch or early design stages of the commission process. Once artwork has been approved or completed, major changes will not be possible. Additional revision requests may incur extra charges.
EmmaMarieArts retains creative discretion regarding artistic style, colour balance, composition, backgrounds, and finishing details.
Pricing & Payment
All prices are listed in GBP (£) unless otherwise stated. The sum of half the total cost is required before work begins unless an alternative arrangement has been agreed in writing. The remaining sum is required when the artwork is finished and must be received before postage.
Payments are processed securely through trusted third-party payment providers, including PayPal and Bank Transfer services. EmmaMarieArts does not store or have direct access to full payment card information.
Prices, services, and product offerings may be updated or discontinued at any time without notice.
Cancellations & Refunds
Due to the custom-made nature of commissioned artwork, refunds are not available once work has begun. If a cancellation request is made before work starts, a full refund may be issued. If work has already started, partial refunds may be considered depending on the stage of completion. Completed commissions are non-refundable.
EmmaMarieArts reserves the right to cancel any order at any time. In such cases, customers will receive either a full refund or a partial refund based on work already completed. For further details, please see my refund policy.
Nothing within these Terms affects your statutory rights under UK consumer law.
Shipping & Delivery
Physical artwork will be shipped using available postal or courier services. Estimated shipping times are not guaranteed and may vary due to postal delays, customs processing, seasonal demand, or courier disruptions.
EmmaMarieArts is not responsible for delays, loss, or damage caused by postal or courier services once items have been dispatched. Customers are responsible for ensuring that all shipping details provided are accurate at the time of ordering.
Copyright & Intellectual Property
All artwork created by EmmaMarieArts remains the intellectual property and copyright of EmmaMarieArts unless otherwise agreed in writing. Customers are purchasing the final physical or digital artwork for personal use only.
Artwork may not be reproduced, resold, altered, distributed, used commercially, minted as NFTs, or used for advertising, branding, or merchandise purposes without prior written permission from EmmaMarieArts.
EmmaMarieArts reserves the right to display completed commissions on social media, websites, portfolios, and promotional materials unless a privacy request is made in writing before completion of the artwork.
Customer Responsibilities
Customers are responsible for providing clear and accurate reference images, ensuring they have permission to use submitted photographs, and reviewing any previews or updates carefully before approval.
EmmaMarieArts is not responsible for issues resulting from poor-quality images, inaccurate information provided by the customer, or failure to properly review approval stages during the commission process.
Website Use
You agree not to use this website for any unlawful purpose or in any way that may harm EmmaMarieArts, its services, or its content. Unauthorised use, reproduction, or distribution of website content, artwork, logos, or written materials is prohibited.
Third-Party Services
This website may contain links, integrations, or payment services operated by third parties. EmmaMarieArts is not responsible for the availability, accuracy, security, or practices of third-party services or websites.
Limitation of Liability
EmmaMarieArts shall not be liable for any indirect, incidental, or consequential losses arising from the use of this website or the purchase of services. Liability is limited to the amount paid for the relevant order to the fullest extent permitted by law.
